The House Manager GmbH ("The Company", "we", "us") is a limited liability company (Gesellschaft mit beschränkter Haftung) incorporated and registered in Switzerland under the Swiss Code of Obligations (Art. 772 ff. OR).

These Legal Terms, Privacy Policy, Confidentiality and Data Protection provisions apply to all services provided by The House Manager GmbH, including real estate brokerage, property management, recruitment, and family office services, as well as to all use of this website.

The processing of personal data by The House Manager GmbH is governed by the Swiss Federal Act on Data Protection (Datenschutzgesetz, DSG) of 25 September 2023, in force since 1 September 2023, and its implementing ordinances, as well as — where applicable — the EU General Data Protection Regulation (GDPR) for data subjects within the European Union.

We collect and process personal data (name, contact details, correspondence, property and tenancy information, contractual documents, and any data you provide via our forms, WhatsApp, or our client portal) solely for the purposes of providing our services, fulfilling contractual and legal obligations, and responding to enquiries. Data is processed on the legal bases of contract performance, legitimate interest, and/or your consent.

We retain personal data only for as long as necessary for the stated purposes or as required by Swiss statutory retention periods (including ten years under Art. 958f of the Code of Obligations for commercial records).

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse, or alteration, in accordance with Art. 7 DSG (data security and data breaches).

Personal data is not disclosed to third parties except where necessary for the performance of our services (e.g. tradespeople, insurance providers, or local authorities acting on your behalf), where required by law, or with your consent.

Any transfer of personal data to countries outside Switzerland or the EEA only takes place if an adequate level of protection is ensured (e.g. an adequacy decision by the Federal Council or the EU Commission, or standard contractual clauses), in accordance with Art. 16–17 DSG.

You have the right to request information about, access to, rectification, restriction, or erasure of your personal data, and to object to its processing (Art. 25 DSG). Requests may be addressed to us at any time via our contact page. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Hallwylstrasse 15, 3003 Bern.

The House Manager GmbH treats all client information, property details, financial information, and business affairs entrusted to us as strictly confidential, both during and after the termination of any business relationship.

Our obligations are complemented by the Swiss Criminal Code, which criminalises the breach of manufacturing or business secrecy (Art. 321 StGB) and the breach of professional confidentiality (Art. 320 StGB). Our employees and contractors are bound by written confidentiality obligations.

Where a specific engagement requires it, we are happy to enter into a separate non-disclosure agreement (NDA) with our clients.

All offers, quotations, and services are provided subject to individual written agreement. Any general terms communicated by the client are only binding if expressly accepted by The House Manager GmbH in writing.

The Company provides its services with the care of a prudent businessman (Art. 398 para. 2 OR) but excludes all liability for indirect damages, consequential damages, and loss of profit to the extent permitted by Swiss law. Our liability for direct damages is limited to the amount of the fees paid for the relevant engagement, except in cases of intent or gross negligence.

All prices are exclusive of Swiss VAT where applicable. Payment terms follow the individual written agreement or, in default thereof, are payable within 30 days of invoice.

These Legal Terms are governed exclusively by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the registered office of The House Manager GmbH, unless Swiss mandatory law provides otherwise.

Swiss mandatory law, including the Federal Act against Unfair Competition (UWG) and, for tenancy matters, the Swiss Code of Obligations (Art. 253 ff. OR), applies to our real estate services.

The House Manager GmbH provides its services — including property management, real estate brokerage, recruitment, and family office services — with the diligence of a prudent businessman (Art. 398 para. 2 OR), acting on the basis of the information, instructions, and documentation provided by the client.

To the maximum extent permitted by Swiss law, The House Manager GmbH excludes all liability for indirect damages, consequential damages, loss of profit, and immaterial damages. Liability for direct damages is limited to the total fees actually paid by the client to The House Manager GmbH for the engagement giving rise to the claim, except in cases of intent or gross negligence.

The Company is not liable for the acts, omissions, or performance of third parties engaged on the client's behalf (such as tradespeople, contractors, insurance providers, or authorities), nor for events of force majeure, official measures, or circumstances beyond the Company's control.

The Company gives no guarantee as to the accuracy, completeness, or timeliness of property details, listing information, or third-party statements published on this website or communicated in connection with our services. Clients are responsible for verifying such information independently.

The client indemnifies and holds The House Manager GmbH harmless from third-party claims arising from information, instructions, or documents provided by the client or from the client's breach of these Legal Terms.

Any liability claims against The House Manager GmbH become time-barred in accordance with the statutory limitation periods of Swiss law, and in any event one year after the date on which the client became aware of the damage and the cause of the claim (Art. 128 ff. OR).

The House Manager GmbH reserves the right to amend these provisions at any time. The version published on this website at the time of your visit applies.
